Shawnigan Toxic Dump Update
Betrayed by our "Private Property 1st" Legal System
March 21st 2016
In a decision applauded by local government and residents, Justice Brian MacKenzie ruled that “permanent encapsulation in engineered cells of refuse, waste or contaminated soil not originating on the property (640 Stebbings Road) was contrary to the CVRD’s zoning for that property. He granted an injunction restraining site owner Cobble Hill Holdings Ltd. and associated companies from accepting and landfilling the soil.
Less than a month later on April 15th 2016
BC Appeal Court Madam Justice Kirkpatrick has given a stay to the two injunctions put in place with Justice Mackenzie’s March 21st ruling, allowing 106,000 more tonnes to be dumped at the site.
May 9th CVRD Appeal Hearing in Vancouver
